B. A public service company or any corps that shall have a right of way of road or highway of any other corporation, or of the United States, shall have the right to construct, establish, lease and maintain, or operate, for railroad purposes, over and along any such right of way subject to the payment of such charges as the Commission may, after notice and hearing, determine to be just and reasonable. The Commission shall keep itself informed as to the character and conditions of the proposed crossing, the extent and kind of traffic over or along the proposed crossing, and the profitable operations thereof. The Commission shall keep itself informed as to the present condition, development and use of the proposed crossing. Where such proposed crossing is a public crossing of a highway with some railroad or rail line, and a public or quasi-public utility whose facilities intersect the highway requires construction of utility crossings or the making of a grade-separation of its facilities at the point of such highway, the public or quasi-public utility may file with the Commission its application therefor. When the relief sought in such application is the crossing of a highway by a public or quasi-public utility requiring grade-separation of its facilities at the point of such highway, then such application shall be in the name of the public or quasi-public utility, and the Commission shall require its publication at least once a month at its office at Roanoke and at least once a week in the county in which such crossing is proposed, in a newspaper approved by the Commission. The Commission may make such investigations of such application as it may deem necessary in order to enable it to determine whether or not to grant the relief sought therein. The Commission may at the hearing submit to cross-examination such witnesses as are named in the application as parties interested in the matters to be investigated, and may require such witnesses to submit to cross-examination. Orders, certificates and other proceedings under this article shall be elicited by verified petition and shall constitute a final order when it is placed on the docket of the Commission. The Commission may at any stage of such proceedings, for good cause shown, and after notice and hearing, take such other action as it may deem proper. Every such order shall contain a finding of fact and determination that the condition or circumstances exist for the safety of the public welfare and for railroad operations, and shall be preceded by a definite statement in the order so declaring the conditions or circumstances. d2c66b5586
